Contract Provisions Roofing Contractors Should Include in Their Contracts
Contracts, particularly for reroofing projects, provide roofing contractors with
a great opportunity to improve their legal position, reduce potential liability
and get paid. This program will present contract provisions purposely drafted to
address potential problematic situations faced by roofing contractors such as design
liability, deck conditions, fumes and wind-uplift testing, as well as provisions
to deal with everyday issues such as payment, indemnification and dispute resolution.

Wage & Hour Issues Most Likely to Create Liability for Roofing Contractors
This program will include an overview of the most common wage and hour issues that
create liability for roofing contractors. Among the issues to be discussed are travel
pay, overtime pay, waiting time, deductions from employee pay and the misclassification
issue of independent contractor versus employee. Attendees will learn when travel
time is compensable, how overtime is calculated for employees compensated at either
a piece rate or by some other method other than an hourly rate of pay, when waiting
time is compensable and when it is improper to make deductions from an employee's
pay check. Attendees also will learn the factors relied on by the Department of
Labor when reviewing whether an employee is being misclassified as an independent
contractor.

Emerging Technical Issues Posing Liability Risks to Roofing Contractors
What are the new and most pressing technical issues facing roofing contractors today?
Mark S. Graham, NRCA's associate executive director of technical services, will
update you about the latest revisions to the 2009 building codes and upcoming 2012
building codes, conflicting manufacturers' guidelines regarding the use of glass-faced
gypsum board products, reported problems with water-based adhesives, and issues
with and changes to TPO membranes.

What Does the New Health Insurance Law Mean to You?
Earlier this year, Congress enacted the most sweeping health care legislation in
at least a generation. The 2,400-plus page law contains numerous mandates, taxes
and other provisions that will affect you in a variety of ways, and it is imperative
you understand how the new health care law and associated regulations will affect
your business. During this program, a panel of knowledgeable professionals will
provide you with an overview of the major employer-related provisions of the new
law and insights on its effects on employers. The panel also will discuss compliance
with employer-related requirements of the law and avoidance of costly new penalties,
among other issues.

Problems Resulting from Moisture Trapped Within Roof Assemblies
Moisture accumulation in roof assemblies is not a new phenomenon, it's the fundamental
law of physics. During this program, you will learn about the fundamentals of moisture
and moisture movement, "self-drying" roofs and vapor retarders, attic ventilation
and unvented roofs, and moisture accumulation and release in concrete roof decks.

Builder's Risk Insurance
What is covered under builder's risk insurance policies, and what is excluded? How
does builder's risk insurance differ from commercial general liability insurance?
What is the difference between builder's risk insurance and an installation floater?
Are there significant differences among builder's risk insurance policies? These
questions will be answered in this session, which will also review the provisions
in standard American Institute of Architects' contract documents regarding builder's
risk insurance, including waivers or subrogation, and discuss roofing and other
court cases interpreting these contract provisions and insurance requirements.

NRCA Issues and Update
During this program, you will hear a brief update about a number of NRCA's initiatives,
including its photovoltaic (PV) roof system educational programs and new certification
program for individuals responsible for installing roof-mounted PV systems. In addition,
NRCA continues to be heavily involved and active in Washington, D.C. working in
support of tax incentives to accelerate demand for energy-efficient roofing, as
well as lobbying and testifying on behalf of small business issues, such as fall
protection and much more.

Vegetative Roofs and PV Installations: New Fire, Wind and Electrical Code Developments
The "green" industry is dynamic and unsettled; code and standard development is
catching up. As a professional roofing contractor, you need to understand the latest
developments and legal implications of new code language and updated standards for
vegetative roof systems and roof-mounted PV systems. During this program, you will
learn about the current and upcoming requirements for fire and wind requirements
in the International Building Code, and electrical updates to the National Electric

Regulatory Update: New and Changing Regulations Affecting Roofing Contractors
Occupational Safety and Health Administration (OSHA) regulations have changed under
the new administration and this is having a profound effect on citation issuance,
fine amounts and the issuance of new and changing regulations—all of which can greatly
affect you and your business. During this program, you will learn how to respond
to the recent OSHA developments affecting fall protection, lead, silica, cranes,
personal protective equipment, recordkeeping and hazard communication, safety and
health programs, and ergonomics standards.

OSHA Penalty Update and Changes in Labor and Employment Policies from the Obama Administration
The Obama administration has instituted major changes to the nation's labor and
employment laws and policies, many of which directly affect the construction industry.
This session will discuss those labor and employment laws and policy changes that
directly affect the construction industry, including President Obama's PLA executive
order, E-Verify requirements for federal contractors, the Department of Labor's
Misclassification Initiative and changes to OSHA's penalty policy. We will also
discuss current issues under the National Labor Relations Act in light of President
Obama's appointment of Craig Becker to the National Labor Relations Board.

Roofing and Construction Cases and Court Decisions
Sometimes, court decisions are surprising. Because case law develops through reliance
