Class-action lawsuit filed against CertainTeed Corp.
A class-action lawsuit has been filed against CertainTeed Corp., Valley Forge, Pa. The maker of Horizon brand roof shingles is being charged with deliberately concealing or suppressing the facts about the shingles "with the intent to defraud."
The initial lawsuit was filed in Erie County, Pa., and similar lawsuits are expected in Wisconsin and Minnesota. Lawyers have identified plaintiffs in 17 states. The lawsuit represents homeowners with deteriorating CertainTeed shingles.
The original Horizon Shangle brand shingles manufactured by CertainTeed around 1987 were made of cardboard covered by asphalt. A new version of the Horizon shingle now has a fiberglass core. The class-action lawsuit claims that the manufacturer failed to test the shingles before putting them on the market. It also states that the shingles "failed prematurely due to moisture invasion, curling, cracking, blistering, deteriorating and otherwise not performing." According to the lawsuit, damaged areas can include roofs, underlying felt and drywall inside homes and total damages are less than $75,000 per home.
Mike Loughery, CertainTeed's communications manager, said that homeowners who have experienced problems with the company's shingles should call (800) 345-1145 to receive an information packet explaining how to file a claim.
